Who am I?

The Data Controller (Hertford Counselling / Emily Sugarman) is registered with the Information Commissioner’s Office https://ico.org.uk/ and this registration is renewed annually. The registered address is Hertford Counselling, Natural Health, 4 Old Cross, Hertford, SG14 1BZ.

What information do I collect?

The information I collect from you is your name, phone number(s), address, email address, and GP surgery. I also, only with your permission via signature of the ‘Written Recording Contract’, record (using audiotape) all face-to-face sessions.

How do I use your personal information?

The ways in which I use your personal information are:For administration (writing to you by email or letter or contacting you by telephone to make arrangements).To review an audio recording of our session together, in order to help me to work better and more effectively.

What legal basis do I have for processing your personal data?

The legal grounds for processing your data are your verbal consent, the contract (entitled 'Framework for Counselling and Psychotherapy') that we both review and sign on commencement of our work together.

When do I share personal data?

The only circumstances in which I might have to share your personal data would be if you tell me about an immediate risk of substantial harm to yourself or others, or if I was legally obliged to do so (eg. via court order).

Where do I store and process personal data?

Any personal data is stored in a password protected file on PC, or in a locked box off the business premises. All audio recordings are stored as encrypted, password-protected files on PC. Phone numbers are stored in the Data Controller’s mobile phone identifiable only by initials and the phone can only be accessed by fingerprint recognition.

How long do I keep your personal data for?

All personal data/information is kept securely for a period of seven years. After this point, the aforementioned data is deleted permanently from any computer records stored locally, and any paper notes are shredded securely and disposed of. Audio recordings are deleted permanently from the Information Controller’s PC. 

Your rights in relation to personal data:

Under the General Data Protection Regulation rules, you have a right to access and control your personal data.You have the right to ask me for copies of your personal information, and to ask me to rectify information you think is inaccurate. You also have the right to ask me to complete information you think is incomplete. You have the right to ask me to erase your personal information in certain circumstances. You have the right to ask me to restrict the processing of your information in certain circumstances. You also have the right to compensation for substantial damage or distress caused by data processing, where applicable.
